Whether you will need immigration attorney will be determined by your reasons for entering the United States, and by your background. If you just want to visit the U.S., you may not even need to obtain a visa. Check with a U.S. consulate or embassy in your country to determine the visa requirements. If you are coming to the United States as a result of a job offer from a U.S. employer, your prospective employer will probably either hire an attorney to do the work, or use someone on staff with specialized training in immigration procedures. In many instances, you may consult an attorney because you are overwhelmed or frustrated by the process of obtaining a green card, or bringing a family member to the U.S., and have been unable to obtain assistance from the Bureau of U.S. Citizenship and Immigration Services (USCIS). If you fear that there is something in your background that may prohibit you from obtaining a green card or bringing a family member to the U.S., or if you or a loved one have been contacted by the USCIS and threatened with deportation, it is well worth it to seek advice from an attorney. In some cases, failing to obtain the advice of an attorney could mean the difference between permanent residence and deportation. Many immigration attorneys will give you a free consultation, or deduct the cost of the consultation from your total fees.

Levering Best-in-Class Immigration Law Services

Family Immigration Lawyer: Foreign nationals have the opportunity to lawfully obtain a green card, or permanent resident status, through the family-based immigration pathway. In order to qualify for permanent residency, foreign citizens must have a relative who is either a United States citizen or permanent resident file a petition on their behalf. The application process will require a permanent resident to complete necessary paper work and applications, as well as provide proof of status and familial relationship to the applicant. The process can be completed if the applicant is currently in the United States on a nonimmigrant visa or if they are outside of the United States.

Naturalization and Citizenship Attorney: N-400: Becoming a United States citizen is often the ultimate goal of foreign nationals who have made the sacrifices to live and work in America. By taking an oath of commitment to their nation and pledging loyalty to the U.S. Constitution, you can be rewarded with the full rights, freedoms and privileges of a true American. In order to obtain U.S. citizenship through naturalization, foreign citizens of nationals must fulfill certain requirements established by Congress in the Immigration and Nationality Act (INA). There are also several available pathways that eligible applicants can complete.

New York Deportation Defense Lawyer: Deportation, also known as removal, is the formal legal process during which the United States government orders a non-citizen to be removed from the country. There are a variety of reasons why a removal may be ordered, nearly all of which involve a violation of U.S. immigration law. The deportation process can be extremely difficult, emotionally complex and frustrating. Removal proceedings will first begin with the U.S. Citizenship and Immigration Services (USCIS) and can be filed against any non-citizen, including nonimmigrant visa holders and green card holders. The case will then be held in an immigration court overseen by the U.S. Department of Justice (DOJ). Depending on the circumstances involved, the defense plan or actions taken and a number of other factors, a judge may rule that deportation be dismissed or proceed as planned. Immigration and Customs Enforcement (ICE) is the agency responsible for carrying out removal orders.

B1 / B2 VISA LAWYER IN NEW YORK: B visa category is reserved for foreign nationals who wish to enter the U.S. temporarily for business (B1) and for pleasure or medical treatment (B2). To determine whether you should apply for B1 or B2, consider the nature of your planned trip. If it is recreational, such as visiting family members, tourism, amusement, or receiving medical treatment, a B2 visa would be more appropriate. If the purpose of your travel is to attend business meetings or scientific conferences, negotiate a contract, settle an estate, etc., you should apply for a B1 visa. Under the Immigration and Nationality Act, a visitor visa applicant is presumed to have immigrant intent. To qualify for a visitor visa, an applicant must prove to the consulate officer that s/he is not an intending immigrant, Prizant Law does that.
